We specialize in representing employees alleging violations of employment laws. Below are key areas where we provide aggressive advocacy, citing specific Massachusetts and federal statutes that protect your rights:

Discrimination and Harassment

Employers cannot discriminate based on protected characteristics. Under federal law, Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex (including pregnancy, sexual orientation, and gender identity), or national origin. The Americans with Disabilities Act (ADA) protects qualified individuals with disabilities and requires reasonable accommodations. The Age Discrimination in Employment Act (ADEA) safeguards workers aged 40 and older. The Genetic Information Nondiscrimination Act (GINA) prohibits discrimination based on genetic information.

In Massachusetts, the Fair Employment Practices Act (M.G.L. c. 151B) provides broader protections, including for ancestry, gender identity, sexual orientation, pregnancy or related conditions, veteran status, and more. Harassment, including sexual harassment, is prohibited as a form of discrimination under both federal and state laws.

Wage and Hour Violations

The Federal Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay (time-and-a-half for hours over 40 in a work week), and recordkeeping requirements. The Equal Pay Act of 1963 ensures equal pay for equal work regardless of sex.

Massachusetts law requires timely payment of wages (weekly or biweekly for nonexempt employees) under M.G.L. c. 149 § 148 and provides for minimum wage and overtime under M.G.L. c.151. We also handle claims under the Earned Sick Time Law , which provides up to 40 hours of job-protected sick time annually.

Family and Medical Leave

The Federal Family and Medical Leave Act (FMLA) provides up to 12 weeks of unpaid, job-protected leave for serious health conditions, family care, or bonding with a new child. Massachusetts’ Paid Family and Medical Leave (PFML) Act offers paid leave benefits that are more generous than federal protections. The Pregnant Workers Fairness Act requires reasonable accommodations for pregnancy-related conditions.

Retaliation and Whistleblower Protection

Retaliation against employees for reporting violations or participating in investigations is illegal. Federal protections exist under Title VII, the ADA, ADEA, and other laws. The National Labor Relations Act (NLRA) protects employees’ rights to organize and discuss working conditions. In Massachusetts, M.G.L. c. 149 § 185 prohibits retaliation for disclosing employer practices that violate the law or pose risks to public health, safety, or the environment.

Wrongful Termination and Other Violations

We pursue claims for wrongful termination in violation of public policy, breach of contract, or other illegal reasons, drawing on both state and federal protections. This includes claims related to unsafe workplaces under the Occupational Safety and Health Act (OSHA).
